Welcome to MariBaDesign.

These Terms of Service ("Terms") govern your access to and use of the MariBaDesign website, products, digital downloads, and related services (collectively, the "Services"). By accessing this website or purchasing any product from MariBaDesign, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use this website or purchase any products.

1. ABOUT MARIBADESIGN

MariBaDesign is an online store specializing in the creation and sale of digital products, including but not limited to:

  • Digital artwork
  • Printable designs
  • PNG files
  • JPG files
  • SVG files
  • PDF files
  • PSD templates
  • AI files
  • Digital graphics
  • Design assets
  • Creative resources

All products sold through MariBaDesign are digital products unless explicitly stated otherwise.

No physical products are shipped.

2. ELIGIBILITY

By using this website, you confirm that:

  • you are at least 18 years old or have permission from a parent or legal guardian;
  • you are legally able to enter into binding agreements;
  • all information you provide is accurate and complete.

3. DIGITAL PRODUCTS

All products sold by MariBaDesign are delivered electronically.

After successful payment, customers will receive access to download their purchased files.

No physical shipment will be made.

Customers are responsible for downloading and safely storing their purchased files.

MariBaDesign is not responsible for files lost due to accidental deletion, device failure, or customer negligence after download has been completed.

4. PRODUCT INFORMATION

MariBaDesign makes every reasonable effort to ensure that product descriptions, preview images, dimensions, colors, and file formats are accurate.

However:

  • colors may appear differently on different screens;
  • printed colors may vary depending on printers, paper, and ink;
  • preview images are for demonstration purposes only;
  • watermark protection shown in previews is removed from purchased files.

Minor differences between preview images and downloaded files do not constitute a defect.

5. PRICING

All prices are displayed in the currency shown at checkout.

MariBaDesign reserves the right to:

  • modify prices at any time;
  • offer temporary discounts or promotions;
  • discontinue products without notice.

Price changes do not affect orders already completed.

6. PAYMENT

Payments are processed through secure third-party payment providers supported by the online store.

MariBaDesign does not store customers' payment card information.

Orders become final only after successful payment authorization.

If payment cannot be completed, access to digital products will not be provided.

7. DELIVERY

Digital products become available shortly after payment confirmation.

Delivery times may vary depending on payment processing, internet connectivity, or temporary technical issues.

MariBaDesign is not responsible for delays caused by payment providers, internet outages, customer email settings, spam filters, or circumstances beyond reasonable control.

Customers are responsible for providing a valid email address and ensuring they can access downloaded files.

8. CUSTOMER RESPONSIBILITIES

Customers agree to:

  • provide accurate purchase information;
  • keep download links confidential;
  • use products only according to the applicable license;
  • comply with all copyright laws;
  • refrain from unauthorized copying or distribution of purchased files.

Customers are solely responsible for ensuring that purchased files are compatible with their software and devices before completing a purchase.

9. ACCEPTABLE USE

You agree not to use MariBaDesign or any purchased products to:

  • violate any law;
  • infringe intellectual property rights;
  • distribute malware;
  • impersonate another person;
  • engage in fraudulent activity;
  • attempt unauthorized access to the website;
  • interfere with website security;
  • scrape or harvest website content without permission.

Violation of these Terms may result in immediate suspension of access without refund.

10. LICENSE GRANT

Unless otherwise stated on the product page, every purchase includes a Personal Use License only.

MariBaDesign grants the purchaser a non-exclusive, non-transferable, revocable license to use the purchased digital files for personal purposes.

Ownership of the artwork and all intellectual property rights remain with MariBaDesign.

Purchasing a product does not transfer copyright ownership.

11. PERSONAL USE LICENSE

Unless specifically stated otherwise, you MAY:

  • Use the files for your own personal projects.
  • Print the artwork for your personal home or office.
  • Use the files as wallpapers or personal decorations.
  • Resize files for your own personal needs.
  • Store backup copies for personal use.

12. PROHIBITED USES

You MAY NOT:

  • Resell the original files.
  • Redistribute the files.
  • Share download links.
  • Upload purchased files to free download websites.
  • Upload purchased files to stock marketplaces.
  • Sell the files on Etsy, Creative Market, Design Bundles, Gumroad, Shopify, or similar marketplaces.
  • Claim the artwork as your own.
  • Remove copyright notices or watermarks from preview images.
  • Give purchased files to friends, family members, clients, or third parties.
  • Include purchased files in digital bundles or collections.
  • Convert the files into another format for resale.
  • Use purchased files in any product intended primarily for redistribution.

Any unauthorized use immediately terminates your license.

13. COMMERCIAL USE

Commercial use is not permitted unless a separate Commercial License is explicitly purchased or granted in writing by MariBaDesign.

If a Commercial License is offered for a particular product, its specific terms will apply in addition to these Terms of Service.

Without a Commercial License, no business, company, organization, or individual may use MariBaDesign products for commercial purposes.

14. AI AND MACHINE LEARNING

Unless expressly authorized in writing by MariBaDesign, customers may NOT:

  • use purchased files to train artificial intelligence models;
  • upload purchased files to AI datasets;
  • use purchased files for machine learning purposes;
  • generate derivative datasets based on MariBaDesign products;
  • use purchased artwork to develop generative AI systems.

MariBaDesign reserves all rights regarding AI training and machine learning applications.

15. COPYRIGHT

All digital products, artwork, graphics, illustrations, previews, logos, website content, designs, and downloadable files are protected by international copyright laws.

All copyrights remain the exclusive property of MariBaDesign.

Unauthorized reproduction, copying, modification, distribution, resale, or publication constitutes copyright infringement and may result in legal action.

16. INTELLECTUAL PROPERTY

All trademarks, graphics, logos, icons, text, images, product previews, downloadable content, branding, and website design belong to MariBaDesign unless otherwise stated.

Nothing contained within these Terms grants ownership of any intellectual property.

Only the limited license described herein is granted to customers.

17. USER CONTENT

If customers voluntarily submit reviews, testimonials, suggestions, photographs, or other content, they grant MariBaDesign a non-exclusive, royalty-free license to display such content for marketing, promotional, and customer service purposes.

Customers confirm they own the rights to any submitted content.

MariBaDesign reserves the right to remove user-generated content at its sole discretion.

18. ACCOUNT SECURITY

If customer accounts are available, customers are responsible for maintaining the confidentiality of their login credentials.

MariBaDesign is not liable for unauthorized access resulting from weak passwords, credential sharing, or customer negligence.

Customers should immediately notify MariBaDesign if unauthorized account activity is suspected.

19. DOWNLOADS

Customers are responsible for downloading purchased digital products within a reasonable period after purchase.

If technical difficulties prevent access to purchased files, customers should contact MariBaDesign using the contact email provided on the website.

MariBaDesign will make reasonable efforts to restore access to eligible purchases where possible.

MariBaDesign is not responsible for download failures caused by:

  • customer internet connection;
  • unsupported software;
  • device incompatibility;
  • browser issues;
  • antivirus software;
  • accidental deletion after download.

20. SOFTWARE COMPATIBILITY

Customers are responsible for reviewing product descriptions before purchase.

MariBaDesign does not guarantee compatibility with every software version, operating system, printer, cutting machine, application, or device unless explicitly stated on the product page.

It is the customer's responsibility to ensure that their software supports the listed file formats.

21. NO PROFESSIONAL ADVICE

Products sold by MariBaDesign are provided for creative and personal use only.

Nothing available through MariBaDesign constitutes legal, financial, tax, medical, engineering, architectural, or professional advice.

Customers are solely responsible for determining whether products are suitable for their intended use.

22. REFUND POLICY

Due to the nature of digital products, all sales are generally final.

Once a digital product has been delivered or made available for download, it cannot be returned.

Refunds may only be issued:

  • if required by applicable consumer protection laws;
  • if the purchased file is permanently corrupted and cannot reasonably be replaced;
  • if the wrong product was delivered due to an error by MariBaDesign;
  • in other exceptional circumstances at MariBaDesign's sole discretion.

Refunds will not be granted because:

  • the customer changed their mind;
  • the customer purchased by mistake;
  • the customer no longer needs the product;
  • the customer failed to read the product description;
  • the customer lacks compatible software;
  • the customer expected features not described on the product page.

23. ORDER CANCELLATIONS

Because digital products become available immediately after payment, orders generally cannot be cancelled once completed.

If payment was duplicated due to a technical error, customers should contact MariBaDesign as soon as possible.

24. CHARGEBACKS

Customers agree to contact MariBaDesign before initiating a payment dispute or chargeback.

Fraudulent chargebacks, false payment disputes, or abuse of payment protection systems may result in:

  • permanent account suspension;
  • termination of download access;
  • refusal of future purchases;
  • legal action where appropriate.

MariBaDesign reserves the right to provide payment processors with documentation demonstrating successful delivery of digital products.

25. DISCLAIMER OF WARRANTIES

All products and services are provided on an "AS IS" and "AS AVAILABLE" basis.

MariBaDesign makes no warranties, express or implied, including but not limited to warranties of:

  • merchantability;
  • fitness for a particular purpose;
  • uninterrupted availability;
  • error-free operation;
  • compatibility with every software environment.

Customers assume all risks associated with downloading and using digital products.

26. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, MariBaDesign shall not be liable for any:

  • indirect damages;
  • incidental damages;
  • consequential damages;
  • loss of profits;
  • business interruption;
  • loss of business opportunities;
  • loss of goodwill;
  • loss of data;
  • computer failures;
  • software conflicts;
  • printing costs;
  • production delays;
  • third-party claims.

MariBaDesign's maximum liability shall never exceed the amount paid by the customer for the specific product giving rise to the claim.

27. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless MariBaDesign, its owner, affiliates, contractors, licensors, service providers, and partners from and against any claims, damages, liabilities, losses, costs, expenses, and legal fees arising out of:

  • your violation of these Terms;
  • your misuse of any digital product;
  • your infringement of intellectual property rights;
  • your violation of applicable laws;
  • your unauthorized distribution or resale of purchased products.

28. TERMINATION

MariBaDesign reserves the right, without prior notice, to suspend or terminate access to the website or purchased services if a customer:

  • violates these Terms;
  • engages in fraudulent activity;
  • abuses refund or chargeback procedures;
  • infringes copyright or intellectual property rights;
  • attempts unauthorized access to the website or its systems.

Termination does not affect rights or obligations that arose before termination.

29. PRIVACY

Your use of MariBaDesign is also governed by the Privacy Policy.

By using this website, you acknowledge that you have read and understood the Privacy Policy and consent to the collection and processing of personal information as described therein.

30. THIRD-PARTY SERVICES

MariBaDesign may use trusted third-party service providers to operate the website and process orders, including payment processors, website hosting providers, analytics services, email providers, and digital download platforms.

MariBaDesign is not responsible for the independent privacy practices or terms of service of third-party providers.

Customers should review the applicable policies of those providers where appropriate.

31. FORCE MAJEURE

The invalid provision shall be replaced by a valid provision that most closely reflects the original intent.

33. NO WAIVER

Failure by MariBaDesign to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.

Any waiver must be made expressly and in writing.

34. CHANGES TO THESE TERMS

MariBaDesign reserves the right to modify these Terms of Service at any time.

Updated versions become effective immediately upon publication on the website unless otherwise stated.

Customers are encouraged to review these Terms periodically.

Continued use of the website after changes have been posted constitutes acceptance of the revised Terms.

35. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws applicable to the jurisdiction in which MariBaDesign operates, without regard to conflict of law principles.

Nothing in these Terms limits any mandatory consumer rights that apply under the laws of the customer's country of residence.

36. ENTIRE AGREEMENT

These Terms of Service, together with the Privacy Policy, Refund Policy, and any applicable License Agreement, constitute the entire agreement between MariBaDesign and the customer regarding the use of the website and the purchase of digital products.

These documents supersede all prior communications, agreements, representations, or understandings relating to the same subject matter.
